FEBRUARY 24, 2011

Ÿ A deputy traveling east on County Road G observed a Ford 150 truck on the north shoulder of the roadway facing west. The deputy turned around and pulled up behind the truck. He observed two females outside the vehicle and could hear a third person off the north side of the roadway in a wooded area. When asked if they needed assistance, they stated they were gathering firewood, and the deputy noted that the bed of the truck was full of wood. A male subject then exited the wooded area with his arms full of wood. The vehicle and suspects’ information was run through dispatch, which advised that the vehicle was reported stolen out of New Mexico. All subjects were handcuffed. Upon questioning, one female subject advised the deputy that she and her husband, the male suspect, were hitchhiking and were picked up by the female driver of the truck, who offered them a ride in exchange for gas money. While traveling, the driver of the truck told the female passenger that she had been in a fight with her boyfriend, and that the vehicle belonged to her. The female passenger informed the deputy that when he initially passed them parked on the side of the road, the female suspect began yelling at them to get in the vehicle so they could leave. The female suspect admitted to the deputy that the truck belonged to her boyfriend, and that they had been in a physical fight where he threw the keys at her face and told her to take the truck. She had not talked to him since she left with the truck. The deputy spoke with the female passenger again, who admitted to driving the vehicle to their present location. A records check revealed that her Utah driving privileges were denied for an alcohol-related offense. She was booked into jail for driving under restraint. The primary female driver was booked into jail for theft. The male suspect was released.

The driver stopped and made a U-turn and began driving northbound toward the deputy’s patrol vehicle. The driver then stopped directly in front of the patrol vehicle. The deputy exited his vehicle and ordered the driver out of his car. The driver was identified as having a revoked license for two alcohol-related offenses. He was placed into custody and charged with driving a motor vehicle when license was restrained for an alcohol/drug related offense.

MARCH 5, 2011

Ÿ While traveling eastbound on County Road G, a deputy observed a vehicle that appeared to be stuck on the side of the roadway. The front end of the vehicle was stuck in the ditch, with the rear of the vehicle in the roadway blocking the southbound lane. A male at the scene approached the deputy to tell him that he was fine, that he was just stuck. While speaking, the deputy noted the male’s speech was slurred and there was a smell of alcohol on his breath. The deputy also observed two bottles of various types of alcohol — one of them empty — on the back seat of the vehicle. When asked if he had been drinking, the driver said no. The male stated that he had tried to turn his car around after realizing that he was driving the wrong way, and the front end of the vehicle went too far into the ditch and he became stuck. When the deputy told the driver that he could smell alcohol on his breath, and pointed out the two bottles in the back seat, the driver adamantly insisted that he did not drink that night. The driver performed voluntary roadside maneuvers poorly, and was placed into custody for further investigation of driving under the influence. After transport to county jail, the driver blew a 0.119 on the breathalyzer. The legal limit in Colorado is 0.08. The driver was charged for driving a motor vehicle while under the influence of alcohol.
