MONDAY, JULY 11
Persingula Tavaepont, 51, of Cortez, pleaded guilty to one count of harassment-strike/shove/kick and received a deferred sentence of 24 months probation, to report this day. She was ordered to pay $1,518.50 in fines and costs, and must complete a domestic violence evaluation and follow all recommendations of same. Additionally, she must violate no laws, traffic or criminal, and keep her address current with the court. All standard conditions of probation apply.
Mario A. Vargas, 26, of Cortez, pleaded guilty to one count of harassment-strike/shove/kick and was sentenced to 10 days in jail to begin July 22, with one day credit for time served, and weekends or work release authorized to serve. He also was sentenced to 24 months state probation, and was ordered to report this same day or on release from jail. The defendant was ordered to pay $1,443.50 in fines and costs. He must obtain a domestic violence evaluation and a substance abuse evaluation, and follow all recommendations. Additionally, he must violate no laws, traffic or criminal, and keep his address current with the court. All standard conditions of probation apply.
TUESDAY, JULY 12
Zachery F. Newell, 25, of Cortez, pleaded guilty to one count of third-degree assault-knowingly/recklessly causing injury. He was sentenced to 45 days in jail, with 44 days credit for time served and 12 months probation. He was ordered to pay $816 in fines and costs, and must perform 72 hours of community service by July 12, 2012. The defendant must follow all recommendations of probation and must write a letter of apology to the victim through counsel, with two months to complete the letter. Restitution is open for 90 days.
Darwin Tom, 27, of Cortez, pleaded guilty to one count of driving while ability impaired. He was sentenced to 10 days in jail beginning July 22, with one day credit for time served, with a stay of execution. He also received a jail sentence of 365 days, with suspended imposition. He received 24 months of probation, to report this day. He was ordered to pay $1,245.50 in fines and costs, and must perform 60 hours of community service by July 12, 2012. He must attend victim impact panel, attitudinal dynamics of driving class, level two education and 68 hours of therapy Track C, and enhanced/intensive outpatient therapy. The defendant was also ordered to submit to random tests for drugs and alcohol use, and obtain a substance abuse evaluation and follow all recommendations of same. He must complete a parenting class through the Pinon Project. The defendant was ordered to follow all standard conditions of probation, including no alcohol or drug use.
Kye Tso-McCook, 19, of Cortez, was found guilty of one count of driving under the influence. She was sentenced to 30 days in jail, with a suspended sentence and 12 months probation, and must report today to state probation. She was ordered to pay $1,279.50 in fines and costs, and was ordered to perform 24 hours of community service, to be completed by July 12, 2012. She must attend victim impact panel, Alive At 25, level two education and 52 hours of therapy Track C, and outpatient therapy. She must also submit to random tests for drugs and alcohol. All standard conditions of probation must be followed, including no alcohol or drug use.
