Lance K. Benally, 21, of Cortez, pleaded guilty to one count of protection order violation. He was sentenced to 10 days in jail, consecutive with case number 11M 331. He was also ordered to pay $209.50 in fines and costs.
Lance K. Benally, 21, of Cortez, pleaded guilty to one count of assault in the third degree recklessly causing injury. Defendant was remanded. He was sentenced to 30 days in jail, and 24 months of supervised probation. He was ordered to pay $1,535.80 in fines and costs. He was ordered to undergo a substance abuse evaluation and treatment if recommended by probation officer, and must also obtain a domestic violence evaluation and begin treatment within two weeks of sentencing. He is under zero tolerance probation, and must have no new charges whatsoever. Defendant must attend parenting classes, and must pay all fines, costs, and any other statutorily imposed or court ordered costs and fees. He shall not contract any financial obligations without prior approval from probation officer or collections investigator. Restitution is open for 90 days.
Sandra Lee Holaday, 30, of Dolores, pleaded guilty to one count of assault in the third degree knowingly/recklessly causing injury. She was sentenced to 24 months of supervised probation with four days credit for time served. She was also ordered to pay $1,503.50 in fines and costs. She must continue and complete domestic violence treatment with Animas Counseling and Inpatient treatment with aftercare as recommended by probation officer at least a 30-day program and complete program successfully within three months. She must submit to random testing for drug and alcohol use. She was ordered to continue mental health treatment as deemed appropriate by probation. Defendant shall not contract any financial obligations without approval of probation officer and/or collections investigator. Additionally, she was ordered to participate in parenting classes from Pinon Project or an appropriate provider.
TUESDAY, JAN. 24
Palemon Jose Arellano, 20, of Cortez, pleaded guilty to one count of underage possession/consumption of alcohol, and to one count of providing alcohol to a minor. He was found guilty on the first count, and received a deferred sentence on the second count of 12 months supervised state probation, all conditions concurrent with case number 11M 392. He was ordered to pay $238.50 in fines and costs. He was also ordered to perform 20 hours of community service.
Palemon Jose Arellano, 20, of Cortez, pleaded guilty to one count of prohibited use/aiming/firing a weapon. He was sentenced to 360 days in jail with suspended imposition, and to 18 months of supervised state probation. He is under a zero tolerance restriction for 360 days; jail sentence is suspended imposition for weapon offense in case number 11M 392. Defendant was ordered to pay $1,220.30 in fines and costs. Restitution is ordered and open for 90 days. He must also perform 20 hours of community service by Dec. 24, 2012. Defendant shall not possess any weapon or any other dangerous devices. He must complete an intake at Cortez Addiction Recovery Services and participate in enhanced outpatient therapy. He must complete a mental health assessment at Axis Health Systems and follow all recommendation, including taking prescribed medications. Defendant shall not associate with females under the age of 18 without the females parental supervision. He is restricted from any alcohol or illegal drug use, and must submit to random tests for drug and alcohol use as ordered by probation. Defendant shall not contract any financial obligations without the approval of his probation officer and/or the collections investigator.
Dick Vandermeyden, 33, of Cortez, pleaded guilty to one count of theft under $500. He was sentenced to 12 months supervised state probation, and was ordered to pay $893.50 in fines and costs. Restitution is open for 90 days. Defendant was also ordered to perform 40 hours of community service by Dec. 24, 2012. He must follow all conditions of probation.
WEDNESDAY, JAN. 25
Sonnie Silas, 27, of Towaoc, pleaded guilty to one count of criminal mischief under $500. He received one day credit for time served, and was ordered to pay $184.50 in fines and costs. Restitution is open for 90 days. Defendant was ordered to perform 100 hours of community service. Proof of useful public service is to be filed with the court within 12 months if not, a warrant will be issued for failure to comply.
Sammy Alberts, 68, of Dolores, pleaded guilty to one count of criminal mischief under $500. He was ordered to pay $184.50 in fines and costs, and to perform 50 hours of community service by July 25, 2012, and it may be completed as community service if the entity has a liability policy of insurance that covers volunteers, and proof of policy must be provided to the court. Restitution is open for 90 days.
