A 26-year-old Dolores resident charged with murder had his arraignment postponed for 61 days on Tuesday afternoon to give his defense more time to see the DNA evidence that has yet to be tested.
Luther Hampson is accused of murdering fellow Dolores resident Jonathan Hayes, 27, whose body was found by hikers Jan. 14 near Dolores.
District Attorney Russell Wasley told Judge Douglas Walker about investigators being informed on the urgency of the DNA testing to be done.
Defense attorney Justin Bogan said that until they receive the findings of the evidence it would be almost impossible to proceed in order to protect Hampsons constitutional rights.
Wasley said a handle with blood of what appeared to be from a straight edge razor was found near Hayes body, so that piece of evidence is one item that needs to be analyzed for DNA.
Prosecutors are maintaining Hayes was stabbed to death.
Walker quashed the discovery motion after the defense said it was fine with the DAs office allowing them to view, but not handle the evidence.
Hampsons new arraignment date is scheduled for Sept. 18 at 1:30 p.m.
