The Rico Fire Protection District will hold their regular meeting on Sept. 17 at 7 p.m. at the Rico Courthouse.
The Rico Municipal Court will be held on Sept. 19 at 4:30 p.m. at the Rico Courthouse, 2. N. Commercial Street in Rico, Colorado.
The Rico Planning Commission will hold their meeting on Sept. 18 at 7 p.m. at the Rico Courthouse. On the agenda under New Business is Rico Land Use Code: greenhouse.
The Rico Town Board will hold their meeting on Sept. 19 at 7 p.m. at the Rico Courthouse. On the agenda under Old Business is Traffic Control: Law Enforcement Vehicle. Work Session: Dog Ordinance. Under New Business is Contract for Services with Enviro-Group for VCUP Vacant Lot Sampling, Toad Flax in Rico, 2013 Work Plan and ice rink.
At the regular Rico Planning Commission meeting held on Aug. 28, the commission reviewed and discussed the draft Institutional Control Ordinance (ICs). Town Attorney Susan Baker addressed a revised draft of the Institutional Controls Ordinance as a work session. The Town of Rico, Trust for Land Restoration (TLR) and Atlantic Richfield Company have revised the Ordinance to address some of the Planning Commissions concerns which were raised during the previous work session on this issue last spring. To the extent that certain requests have not been addressed, the remaining provisions were determined to be necessary to meet state requirements and/or were necessary to effectively implement the VCUP/ICs program. The Town of Rico, Trust for Land Restoration and ARCO has also been consulting with the State (CDPHE). The State is basically in agreement with the current draft so that following this work session, the Town Staff hopes to schedule the Ordinance for formal Planning Commission review during its September meeting. At that time the Planning Commission may make a final recommendation for approval of the Ordinance to the Towns Board of Trustees. The final adoption of the ICs Ordinance will constitute an amendment to the Towns Land Use Code.
Pat Willits/Trust for Land Restoration and by phone Tom Bloomfield and David Folkes reviewed the Institutional Control Ordinance with the Planning Commission members. Some of the concerns brought up and discussed are the financial assurance shows the cost went up and why, soils, repository, the impact to the streets including alleys and who decides soil sampling. The dirt was an issue after clean up. The Deed Notice was questioned who takes care of that to assure that the owners have it recorded. Pat Willits stated he will create a standard form and bring it to the Planning Commission for review. Town Attorney Susan Baker stated they will take all the concerns back to ARCO for further discussion. Ms. Baker mentioned that the Town will also need to review its Land Use Code and make needed amendments to certain sections to comply with the new Ordinance. The State wants to assure that the Town has full injunctive relief authority in relation to enforcement of the Institutional Controls.
Item 2. Keith Lindauers Proposed Building Permit for Rico Mercantile in historic district. Town Manager Michael England informed the Planning Commission that Scott Livesay is proposing to create two independent businesses in the Mercantile Building within the Rico Historical District. Mr. Livesay is proposing to build a greenhouse. An application has not been filed for a Historic LandMark Alternation Certificate at this time. Mr. England stated he is not asking for approval or denial concerning the proposal. His intent is to only solicit any verbal comments from the Planning Commission. New development within the Rico Historical District has been extremely limited within the last several years, so Mr. England was asking for any comments relative to this proposed application to assist staff in moving forward with an application, if the applicant submitted an application for a Historic Land Mark Alteration Certificate. After a brief discussion, the Planning Commission suggested to include any greenhouse regulation the same time they are considering other amendments to the Land Use Code.
